El objeto de este trabajo es el estudio de la regularización voluntaria en el delito fiscal contenida en el apartado cuarto del artículo 305 del Código Penal. Esta figura, que se basa en la idea de la autodenuncia y la reparación, permite al autor del delito cumplir de forma extemporánea sus obligaciones tributarias, eliminando las penas que hubieran podido derivarse de su conducta delictiva. La importancia que revisten los efectos que la citada norma anuda a la aplicación dela regularización exige examinar con detalle los requisitos que deben concurrir para que esta cláusula sea plenamente operativa. Precisamente, dada la relevancia práctica de esta cuestión, tras realizar una somera aproximación al origen, fundamento y naturaleza jurídica de la regularización, el presente estudio se centrará en examinar en profundidad los presupuestos positivos y temporales exigidos por la doctrina y la jurisprudencia para apreciar la regularización voluntaria en sede penal. The aim of this paper is to study the voluntary tax regularization in the fiscal offense contained in the fourth section of article 305 of the Criminal Code. This figure, based on the idea of self-denouncement and reparation, allows the author of the offense to comply with his tax obligations extemporaneously, eliminating the penalties that could have been derived from their criminal conduct. The importance of the effects that the aforementioned norm ties to the application of the regularization requires a detailed examination of the requirements that must be met in order for this clause to be fully operational. Precisely, given the practical relevance of this issue, after making a brief approximation of the origin, basis and legal nature of the regularization, the present study will focus on examining in depth the positive and temporary budgets required by the doctrine and jurisprudence to appreciate the voluntary regularization in criminal headquarters.
