Los problemas de aplicación del artículo 1535 del código civil y la Ley 511 del Fuero Nuevo

Abstract

El presente trabajo tiene como finalidad el estudio del derecho de cesión de créditos y la aplicación jurisprudencial que se ha venido realizando al respecto. Concretamente, es objeto de tratamiento la protección del deudor cedido y los problemas de aplicación del artículo 1535 del Código civil y la ley 511 del Fuero Nuevo. Para ello, se realiza un recorrido de los preceptos mencionados partiendo de su origen y la Lex Anastasiana, su regulación actual y sus consecuencias jurídicas entre otras cuestiones. Finalmente, se estudia la jurisprudencia más reciente al respecto. El trabajo, por tanto, tratará de ofrecer una visión sobre los problemas en cuanto a la posibilidad de hacer efectivo el derecho de la lex anastasiana, la incorporación por parte de los tribunales de exigencias no contempladas en la norma y los problemas aplicativos que han venido sucediendo en cuanto a la operatividad del régimen de Navarra.

The purpose of this work is to study the right of assignment of credits and the jurisprudential application that has been carried out. Specifically, the protection of the assigned debtor and the problems of application of the article 1535 of the Spanish Civil Code and the regulation made by Navarra’s Fuero Nuevo (Ley 511). For this purpose, the Anastasian law, the origin of the articles, the current regulation and the legal consequences among other issues are analyzed. Finally, the most recent jurisprudence about assigment of credits is studied. This work, therefore, will try to provide an overview of the problems about giving effect to the right of the Anastasian law, the incorporation by the courts of requirements not contemplated in the normative and the application problems regarding the operability of the Foral Normative that regulates the matter.
