Abstract

En este Trabajo de Fin de Grado nos centramos en los aspectos jurídicos relacionados con los contratos de gestación por sustitución . Procederemos a analizar la última jurisprudencia emanada del Tribunal Europeo de Derechos Humanos en la que se determina la incidencia de los derechos contenidos en el Convenio Europeo de Derechos Humanos en dichos contratos. Asimismo, abarcaremos la situación actual de dichos contratos en España. Para ello, examinaremos las resoluciones judiciales que han interpretado estos acuerdos y estudiaremos la legislación que ha influido en los mismos, como son la nueva Ley del Registro Civil, en vacatio legis, el Proyecto de Ley de Jurisdicción Voluntaria nº 121/000112 así como el papel que ha desarrollado la Dirección General de los Registros y del Notariado. Por último, consideraremos los derechos, principios y bienes jurídicos implicados en dichos contratos, su consideración e incidencia en los contratos de gestación por sustitución.

This final academic paper contains the novelties about the contracts of surrogate motherhood. We will examine the most recent case-law pronounced by the European Court of Human Rights in which the Court determinate the influence of these rights written down in the European Convention on Human Rights in these contracts. Furthermore, we will study the current situation of these contracts in Spain. Therefore, we will analyse the judicial resolutions which have interpreted these agreements and the legislation which affects these practises, such as the new Law 20/2011, of the Civil Registry, the bill of voluntary jurisdiction nº 121/000112 as well as the role carried out by the resolutions related to these agreements. Finally, we will consider the rights, principles and legal rights involved in these contracts, its importance and incidence in the agreements about surrogate motherhood.
