In actually, there are numerous nosocomial infections in hospitals and their
facilities. In healthcare, is common the existence of an unexpected and undesired result
of treatment. For this reason, many patients claim a compensation for the suffered
damage by the spread of nosocomial infection.
In this report, will be analyzed those aspects of medical liability that has had an
important significance in jurisprudence, as the damage, the cause and the guilt. Also, for
a better view of the practical application of the regulation, this report look into the
evolution that has suffered the liability regime in the Supreme Court, especially in cases
of nosocomial infections.
