The impact of artificial intelligence in armed conflicts and International Humanitarian Law

La ciberseguridad se ha convertido en las últimas décadas en una amenaza cada vez mayor para el mundo que conocemos. Individuos, Estados y empresas pueden ser víctimas de un ciberataque, pero también las partes de un conflicto armado, desafiando las reglas del juego: el Derecho Internacional Humanitario. Este trabajo pretende definir cómo funcionan esas reglas del juego y cómo están actuando los hackers. Se examinará la aplicabilidad del Derecho Internacional Humanitario en caso de ciberataques en términos de demarcación territorial, agentes implicados y tipo de violencia empleada. La trazabilidad y descentralización de los atacantes ha demostrado ser uno de los retos más difíciles para el DIH a la hora de perseguir la ciberguerra, y debe abordarse mediante un enfoque multidisciplinar, que incluya a expertos en ciberseguridad en la trazabilidad del ataque y a profesionales del Derecho en el problema de la atribución.

Cybersecurity has become an increasingly threat for the world we know during the last decades. Individuals, states, and companies can be victims of a cyber-attack, but also parts to an armed conflict, challenging the rules of the game: International Humanitarian Law. This work aims to define how those rules of the game function and how cyberoperations are being employed by hackers. The applicability of International Humanitarian Law in case of cyberattacks will be examined in terms of territorial demarcation, agents involved in and type of violence employed. Traceability and decentralization of the attackers has proven to be one of the hardest challenges for IHL to persecute cyberwarfare, and must be addressed by a multidisciplinary approach, including cybersecurity experts on the traceability of the attack and law professionals on the problem of attribution
