dc.description.abstractEl presente trabajo gravita en torno a la intervención provocada que se trata de una figura procesal de novedosa regulación en el ordenamiento jurídico. Para entender de manera omnicomprensiva dicha figura vamos a analizarla desde una doble perspectiva; de un lado, su regulación contenida en el artículo 14 de la Ley de Enjuiciamiento Civil (en adelante LEC). De otro lado, conforme a la disposición adicional 7ª (ahora DAS) de la Ley 38/99 De Ordenación De La Edificación, de 6 de noviembre de 1999 (en adelante LOE). Ésta ley permite al demandado inmerso en un proceso de responsabilidad por defectos en la edificación solicitar que se notifique la demanda a otros agentes intervinientes en el proceso constructivo. Tal figura ha generado una gran divergencia tanto doctrinal como jurisprudencial en relación al status procesal del tercero llamado al proceso así como también respecto a quién se debe imponer las costas derivadas de su intervención.es_ES
dc.description.abstractThis work gravitates around the provoked intervention is a procedural figure of new regulation in the legal system. To understand how all-encompassing this figure we will analyze it from two perspectives ; on the one hand , the rules contained in Article 14 of the Civil Procedure Act (hereinafter LEC ) . On the other hand , according to the additional provision 7th (now DAS ) of Law 38/99 of Construction Planning of 6 November 1999 (hereinafter LOE) . This law allows the defendant immersed in a process of liability for defects in the building request that demand notify other agents involved in the construction process . Such figure has generated a wide divergence both doctrinal and jurisprudential regarding the procedural status of the third called the process as well as on who should impose the costs arising from its intervention.es_ES
