| dc.description.abstract | Este trabajo se circunscribe a la reforma que se ha acometido por la LO 1/2015 en materia de insolvencias punibles y más en concreto a los problemas que devienen de las modalidades de insolvencia punible documental recogidas en los arts. 259.1 aps. 6º a 8º. Es decir, se centrará en el estudio del contenido de aquellas conductas que se refieren a la insolvencia por errores e incumplimientos de la normativa contable ya que, contrariamente a lo que expresa el preámbulo de la mencionada Ley Orgánica, las dificultades en la determinación de estas conductas y su interpretación son enormes. Además, se abordarán las dificultades de desvincularlas de la normativa concursal en materia de calificación de concurso culpable y se tratará de ofrecer alguna clave interpretativa y de concreción de las conductas típicas. | es_ES |
| dc.description.abstract | This work is confined to the reform that has been undertaken by LO 1/2015 in terms of punitive insolvencies and more specifically to the problems which result from the forms of punishable documentary insolvency collected in arts. 259.1 Rev. 6th to 8th. That is, it will focus on the study of the content of those behaviors that refer to insolvency due to errors and non-compliance with accounting regulations, since, contrary to the preamble of the aforementioned Organic Law, the difficulties in determining these Behaviors and their interpretation are enormous. In addition, the difficulties of disassociating them from insolvency rules will be dealt with in terms of the qualification of a guilty contest, and an attempt will be made to offer some interpretive and concrete keys to the typical conduct. | en |
