El trabajo de fin de grado persigue el análisis sobre el abandono emocional y el
maltrato psicológico de los legitimarios respecto de sus ascendientes y si dichas
conductas pueden ser susceptibles de ser subsumidas en los conceptos legales
contenidos en el artículo 853.2 CC o no, derivándose de ello los efectos propios de la
desheredación justa o injusta respectivamente. Para ello se estudia la figura de la
desheredación que permite sortear las limitaciones a la libertad dispositiva mortis causa
que supone el sistema de legítimas previsto en el Código Civil. Ello se ha llevado a cabo
a partir de la consideración conjunta de la Constitución Española como norma suprema
de nuestro ordenamiento jurídico y del Código Civil como cuerpo en el que se contiene
la dimensión que a tal régimen ha otorgado el legislador en ejercicio de su potestad y
como máxime el respeto a las garantías constitucionales de protección de la propiedad
privada, la herencia y la familia en su dimensión social y económica. [--]

In this final project we analyse the behaviours that the descendants perform on
their ascendants that could cause this emotional abandonment and psychological abuse
and if any of those behaviours can be reflected in Article 853.2 CC or not: hence the
effects of the right or unjust disinherit of the descendants. To this purpose, we analyse
the inheritance law and the deprivation of Statutory Minimum share of a decedent’s
Estate based on what it is state on our legal system taking the Spanish Constitution as
the supreme norm and the Civil Code as the body that contains the constitutional
guarantees of protection of the right of private ownership of property, inheritance and
family in a social and economic dimension.
To this end, the figure of the disinheritance of the raison d'être has been
analyzed, as opposed to circumventing the limitations on dispositive freedom mortis
causa that is supposed to be the system of laws provided for in the Civil Code.
Therefore, this succession regime has been analyzed, characterized by the unavailability
of the legitimate and the law in our order: it has been carried out from the joint
consideration of the Spanish Constitution as the supreme norm of our legal system and of the Civil Code as the body that contains the dimension that the regime has granted
the legislator in the exercise of its power and as maximum respect for constitutional
guarantees of protection of private property, inheritance and family in its social and
economic dimension. [--]
