Minorías nacionales: concepto y elementos definitorios. Especial referencia a la comunidad gitana en España.

Abstract

El presente trabajo ha tenido por objeto analizar el concepto de “minoría”, atendiendo a las distintas definiciones e interpretaciones que se han llevado a cabo tanto a nivel doctrinal como jurisprudencial. En este sentido, se ha realizado un estudio de uno de los grupos más representativos en España: la minoría gitana. Partiendo de su reconocimiento a nivel institucional, se hace referencia a distintos indicadores que evidencian la compleja situación que viven en la actualidad, como la pobreza, vivienda, participación en el mercado de trabajo, nivel educativo, sanitario o la discriminación. En último lugar, se estudia la validez del matrimonio contraído por el rito gitano para el acceso a la pensión de viudedad.

The purpose of this paper has been to analyse the concept of “minority”, taking into account the various definitions and interpretations that have been carried out at both the doctrinal and jurisprudential levels. In this regard, a study has been carried out of one of the most representative groups in Spain: the Roma minority. Based on its recognition at the institutional level, reference is made to various indicators that highlight the complex situation they are experiencing today, such as poverty, housing, participation in the labour market, education, health and discrimination. Lastly, the validity of marriages contracted by the Gypsy rite for the entitlement to a widow´s pension is examined.
