Para ello, se abordará el alcance de las facultades de éstos, que serán distintas según se trate de menores maduros o no, y el papel que pueda corresponder a los representantes legales cuando de lo que se trata, en este contexto, es del ejercicio de los derechos de la personalidad. Se propondrán las coordenadas básicas desde las que afrontar uno de los principales desafíos que se plantean en esta materia: cómo promover la autonomía personal de los menores de edad en el marco de la toma de decisiones sanitarias, sin descuidar su condición diferenciadora (minoría) y su posible situación de vulnerabilidad, desde la perspectiva de la protección de su interés superior.This paper’s object is the analysis of the minor’s autonomy to decide within the health field. To this end, the scope of the faculties of minors, which will be different depending on whether they are mature or not, and the role that may correspond to legal representatives will be addressed. All this having in mind that, in this context, the exercise of rights relating to the personality is involved. One of the main challenges that arise in this area deals with the question of how to promote the personal autonomy of the minors in the framework of health decision-making, without neglecting their differentiating condition (minority) and their possible situation of vulnerability from the perspective of protecting their best interests.
