De este modo, se exige que el facultativo proporcione a aquél la información necesaria a fin de que pueda adoptar una decisión consciente sobre la concreta intervención médica. Sin embargo, desde el punto de vista de la declaración de responsabilidad médica derivada de la omisión o defecto del consentimiento informado dicha figura suscita diversas controversias jurídicas. Tal complejidad se aprecia de forma clara al estudiar las características del consentimiento, así como el contenido que debe tener la información que ha de proporcionarse al paciente y las diferentes posiciones doctrinales que existen al dilucidar la clase de daño que se causa con dicha ausencia de consentimiento.Informed consent is an essential element of the lex artis which protects the right of autonomy of the patient. In this way, it is required that the doctor provides the necessary information to the patient in order that this one could adopt a conscious decision about the medical intervention. Nevertheless, from the point of view of the medical responsibility declaration due to the omission or defect of the informed consent this figure raises several legal controversies.
