Este privilegio, de dudosa constitucionalidad, desapareció en España con la reforma de la Ley Hipotecaria de 2015, tras la Sentencia del TEDH en el caso SA del Ucieza contra España, dictada un año antes, que precipitó una reforma inaplazable. A día de hoy, se plantea el problema de la cuantificación del número de inscripciones practicadas siguiendo este sistema, así como qué posibilidades reales existen de impugnar las inscripciones ya realizadas. En este artículo estudiaremos el Informe del Gobierno de España de 16 de febrero de 2021, en que se abordan todas estas cuestiones, así como las soluciones posibles para resolver los retos jurídicos planteados.Historically, the Catholic Church was authorized in Spain to proceed to register real estate in its name, based on certificates of ownership issued by the Bishops. This privilege, of dubious constitutionality, disappeared in Spain with the reform of the Mortgages Act of 2015, after the Sentence of the ECHR in the case of SA del Ucieza against Spain, issued a year earlier, which precipitated a reform that cannot be postponed. Nowadays, some problems remain, such as the quantification of the number of registrations made following this system, as well as the evaluation of the real possibilities in order to challenge the registrations already made.
