Diritto e Processo. 33-60 .1722-1110https://academica-e.unavarra.es/handle/2454/43705In the last few decades, the legal institution of marriage has witnesses a progressive reduction of judicialization and has in practice become a 'private affair' of the spouses. The reformed separation and divorce system, allows for the personalization of the solutions offered in case of matrimonial crisis and a less interference of the public system in such a private issue. In fact, marriage has lost its 'public value', and the public powers just maintain a minimum role of legality control and protection of the minors' best interest.
