La nueva ley de navegación marítima desde el punto de vista internacional: parte procesal y responsabilidad civil por contaminación marina de hidrocarburos

Abstract

La gran mayoría del transporte de mercancías se desarrolla en el medio marino. Este hecho propicia la creación y desarrollo de normas reguladoras de este entorno, promulgando una creciente especialización del Derecho Marítimo. El legislador nacional, no ha querido quedarse atrás y ha creado la Ley 14/2014 de Navegación Marítima, con la que pretende adquirir un mayor protagonismo en el plano internacional. Por otro lado, este incremento del comercio por el medio marino, lleva aparejado un mayor nivel de contaminación marítima que intenta ser paliado mediante medidas preventivas y reparadoras establecidas por la OMI. Este trabajo tiene como finalidad el análisis jurídico, desde una perspectiva internacional, de la Nueva Ley de Navegación Marítima, haciendo incidencia en algunas de las cuestiones más controvertidas que afloran en el desarrollo de esta importante actividad comercial.

Bestalde, Itsaso bidez eginiko merkataritza igoerak itsa kutsadura maila areagotu du, eta guzti honi aurre egiteko OMI-k ezarritako prebentzio neurri, zein neurri zuzentzaileak beharrezko bilakatzen dira. Ondoren agertzen dugun ikerlan honen helburua Itsas Nabigazio Lege berriaren analisi juridikoa egitea da, beti ere nazioarteko ikuspegia azterlanaren oinarri izanik.

Most part of the commodity transport takes place in the marine environment. This fact supports the development and creation of new rules that regulate this environment, thereby achieving a higher specialization of Maritime Law. The national legislator has created the 14/2014 Maritime Shipping Law, with which intends to acquire a greater role in the international area. On the other hand, this increase of the commercial trades in the marine environment entails a higher level of maritime pollution that tries to be mitigated by preventive and remedial measures of the IMO. The aim of this work is to analyze the New Maritime Shipping Law from an international perspective. We will stop at the explanation on some of the most controversial issues that arise in the development of this important business.
