Abstract
La regulación hecha por el Fuero Nuevo de Navarra de la rescisión por lesión ha
llamado frecuentemente la atención de la doctrina por su especialidad dentro de los

La regulación hecha por el Fuero Nuevo de Navarra de la rescisión por lesión ha
llamado frecuentemente la atención de la doctrina por su especialidad dentro de los
Derechos españoles. Muchos de los autores que se han ocupado de la materia señalan
que la actual regulación del Fuero se separa de los antecedentes históricos de la figura al
exigir, dentro de su supuesto de hecho, un elemento subjetivo (la "apremiante necesidad
o inexperiencia" del perjudicado, que le llevarían a concluir el contrato) además del
elemento objetivo de la lesión en más de la mitad. Esta regulación puede ponerse en
conexión con algunos Ordenamientos extranjeros cuyo estudio sirve para constatar que
los redactores del Fuero, al regular esta figura, se alejaron de la concepción clásica de la
lesión basada únicamente en el desequilibrio entre las prestaciones de las partes, para
evolucionar hacia una tendencia más moderna que encuentra su fundamento en la
protección de la parte débil del contrato, aunque esta se aleje del ámbito estricto de la
lesión. Además, del examen de diversos proyectos normativos contemporáneos, tanto de
ámbito europeo como nacional, podemos concluir que dicha tendencia no solo no está
superada sino que aparece de distintas formas en las regulaciones, cuyo análisis puede
servir para plantear la posible evolución de la normativa foral reguladora de la materia [--]

The regulation made by Navarra’s Fuero Nuevo of the rescission by lesion has
frequently called the attention of the experts because of its specialty within the Spanish
legislations. Many of the authors who have dealt with this matter think that the current
regulation of the Fuero differs from the historical records of the institution by
demanding, within its assumption of fact, a subjective element (the "urgent need or
inexperience" of the injured party, which would lead him or her to conclude the
contract) apart from the objective element of the lesion in more than one half. This
regulation can be brought into connection with some foreign Ordinances whose study
helps to verify that the writers of the Fuero, in regulating this figure, moved away from
the classic conception of the lesion based only on the imbalance between the benefits of
the parts, to evolve towards a more modern trend based in the protection of the weakest
contracting party, even if it moves away from the strict scope of the lesion. In addition,
from the review of various contemporary normative projects at both European and
national level, we can conclude that this trend is not overcome. It appears in various
forms in different regulations, whose analysis can serve to show the possible evolution
of the Foral Normative that regulates this matter [--]
