tradicionalmente polémico. La doctrina ha ofrecido diferentes tesis sobre su ámbito de aplicación,

The regulation of the surface right, that take refuges in the legislation of the
ground, has been a traditionally controversial subject. The doctrine has offered different theses
on its scope of application, the character of that right surface, or the possible compatibility
of those norms with the little regulation that welcomes the civil Code. To these questions

to approach the discipline of this civil institution in their city-planning norms. The new regulation
that offers the Real Legislative Decree of 2/2008, of 20 of June, lays new ways of reflection
on all those questions in which they have played a fundamental role the jurisprudence
of the Supreme Court and criterion of the Constitutional Court. [--]
