El robo de bebés: análisis de la problemática a la luz del derecho penal

Abstract

CEl consentimiento informado constituye un elemento esencial de la lex artis a través del cual se protege el derecho de autonomía del paciente. De este modo, se exige que el facultativo proporcione a aquél la información necesaria a fin de que pueda adoptar una decisión consciente sobre la concreta intervención médica. Sin embargo, desde el punto de vista de la declaración de responsabilidad médica derivada de la omisión o defecto del consentimiento informado dicha figura suscita diversas controversias jurídicas. Tal complejidad se aprecia de forma clara al estudiar las características del consentimiento, así como el contenido que debe tener la información que ha de proporcionarse al paciente y las diferentes posiciones doctrinales que existen al dilucidar la clase de daño que se causa con dicha ausencia de consentimiento.

Informed consent is an essential element of the lex artis which protects the right of autonomy of the patient. In this way, it is required that the doctor provides the necessary information to the patient in order that this one could adopt a conscious decision about the medical intervention. Nevertheless, from the point of view of the medical responsibility declaration due to the omission or defect of the informed consent this figure raises several legal controversies. Such difficulty can be seen clearly by studying the characteristics of the consent, as well as the content that should have the information that must be provided to the patient, and the different doctrinal positions that exist to clarify the kind of damage that is caused with the consent absence.
