Proceso de modificación de la capacidad de obrar

Abstract

La modificación de la capacidad (incapacitación) de las personas se contempla en nuestro ordenamiento jurídico como una medida de protección y apoyo de las personas físicas que no pueden autogobernarse. En el presente trabajo analizamos todas las fases que forman el proceso civil de modificación de la capacidad, centrándonos en sus especialidades y en la problemática que se da en la práctica jurisdiccional. Finalmente, desarrollamos las instituciones de guarda y protección vigentes legalmente en este momento, sin perder de vista la posible modificación que se puede producir a raíz del Anteproyecto de Ley por la que se reforma la legislación civil y procesal en materia de Discapacidad (ALPD).

Changing the capacity (incapacitation) of persons is envisaged in our legal system as a measure of protection and support for natural persons who cannot self-govern themselves. In this work we analyse all the phases that form the civil process of capacity modification, focusing on their specialties and the problem that occurs in judicial practice. Finally, we develop the institutions of guard and protection in force legally at this time, without losing sight of the possible modification that may occur following the Draft Law reforming civil and procedural legislation on Disability (ALPD). In addition, and in order to face this subject from a practical and useful point of view for the practice of law, we will attach an annex with forms and necessary documentation in this field (One of the criteria for evaluation is to apply the knowledge and skills acquired in the master's degree).
