La tutela del menor en las redes sociales

Abstract

Las redes sociales han irrumpido en nuestra sociedad como la principal fuente de comunicación y difusión de contenido. En este contexto, la relación, conexión y proximidad que sienten los menores con dichas plataformas es mayor que la de cualquier otro colectivo. A pesar de las múltiples oportunidades que presentan, la falta de madurez, de conciencia y de experiencia de aquellos hace que su actuación no se guíe por la prevención y prudencia que debería, provocando que su exposición a los riesgos y la probabilidad de que sus derechos se vean vulnerados aumenten considerablemente. Por ello, el Legislador debe ser capaz de ofrecer mecanismos de tutela civil y penal que tengan en cuenta la especificidad de la infancia y su marcada vulnerabilidad. Así se ha procurado, pero todavía queda adaptar el marco normativo tradicional a los problemas que la era digital plantea y cubrir las lagunas existentes.

Social networks have burst into our society as the main source of communication and dissemination of content. In this context, the relationship, connection and proximity that minors feel with these platforms is greater than that of any other collective. Despite the many opportunities they present, their lack of maturity, awareness and experience means that their actions are not guided by the prevention and prudence that they should, causing the increase of their exposure to risks and of the likelihood that their rights will be infringed. Therefore, the legislator must be able to offer civil and criminal protection mechanisms that take into account the specificity of childhood and their marked vulnerability. Efforts have been made, but it still remains to adapt the traditional regulatory framework to the challenges of the digital age and to fill the existing gaps.
