Las reformas del Fuero Nuevo (1975-2019)

Abstract

La Compilación del Derecho Civil de Navarra o Fuero Nuevo fue el último de los textos de derecho privado foral o especial en ver la luz. Desde su promulgación, en el año 1973, hasta el pasado año 2019, únicamente había sido objeto de lo que puede considerarse una reforma en el año 1987 para adecuarse a la Constitución. A partir de ese momento, el legislador navarro, pese a ser consciente de la necesidad de abordar su reforma integral, utilizó la técnica de las leyes especiales para regular materias puntuales y relativas fundamentalmente al derecho de familia que debieran haberse incluido en su texto. Puede, por ello, afirmarse, que el derecho civil navarro ha vivido alejado de la realidad social. Y puede, también, afirmarse, que el objetivo principal de la reforma operada por la Ley Foral 21/2019, de 4 de abril, de actualización y modificación de la Compilación del Derecho Civil Foral de Navarra o Fuero Nuevo, ha sido la apertura y el acercamiento de su texto a la realidad de las relaciones privadas de la ciudadanía navarra.

The Compilation of Civil Law of Navarre or New Legal Code was the last of the texts on regional or special private law to come into existence. Since its enactment, in 1973, up until last year, 2019, it was only subject to what could be considered a reform in 1987 in order to adapt to the Constitution. From then on, the Navarre legislator, despite being aware of the need to carry out a comprehensive reform, used the technique of the special laws to regulate specific matters, and those mainly relating to family law, which should have been included in its text. It is thus possible to state that Navarre civil law has been distanced from social reality. And it can also be said that the main aim of the reform introduced by the Regional Law 21/2019, of 4 April, amending and updating the Compilation of Regional Civil Law of Navarre or the New Legal Code, was to open up and bring the text closer to the reality of the private relations of the citizens of Navarre.
