Protección de trabajadores sensibles durante la crisis del COVID-19

Abstract

La pandemia por COVID-19 ha supuesto, en el ámbito laboral, la aparición de numerosas leyes y recomendaciones dirigidas a hacer frente a una situación excepcional. En materia de prevención de riesgos laborales, el nivel de exposición de los trabajadores en el medio laboral puede suponer una merma en su estado de salud. Su incidencia ha sido especialmente importante respecto a los trabajadores especialmente sensibles, pues la determinación de un trabajador como tal frente al COVID-19 supone un reto y una serie de obligaciones específicas. Este trabajo analiza, por una parte, el concepto general de trabajador especialmente sensible. Por otra, aquellos factores que determinan esta condición frente a la enfermedad del COVID-19. Igualmente, se estudian las obligaciones del empresario respecto a este grupo de trabajadores, para lo que se tienen en cuenta las recomendaciones emitidas por diversas entidades sobre medidas preventivas a adoptar respecto a los trabajadores especialmente sensibles al COVID-19.

The COVID-19 pandemic has led, in the workplace, to the appearance of numerous laws and recommendations aimed at dealing with an exceptional situation. In terms of occupational risk prevention, the level of exposure of workers in the workplace can lead to a decline in their state of health. Its impact has been particularly important with respect to particularly sensitive workers, since the determination of a worker as such in the face of COVID-19 involves a challenge and a series of specific obligations. This paper analyzes, on the one hand, the general concept of a particularly sensitive worker. On the other hand, the factors that determine this condition in relation to the COVID-19 disease. It also studies the employer's obligations with respect to this group of workers, taking into account the recommendations issued by various organizations on preventive measures to be adopted with respect to workers who are especially sensitive to COVID-19.
