El consumidor de electricidad generada a partir de fuentes de energía renovables: las garantías de origen

Abstract

El objeto de este artículo es realizar un estudio relativo a la regulación de la figura de la ‘garantía de origen’ en relación con el consumidor final de electricidad generada a partir de fuentes de energía renovables. En este sentido, en primer lugar con carácter general se examina la evolución legislativa en torno a esta figura tanto en el Derecho comunitario como en el Derecho español. En segundo lugar, en el marco de la legislación examinada, se hace referencia a la definición de garantía de origen recogida en la normativa española. Finalmente, en relación con los consumidores de electricidad de origen renovable, se identifica cuál es el consumidor final de electricidad con garantía de origen renovable y se realizan algunas consideraciones relativas tanto al valor actual de estas garantías de origen así como a la protección del consumidor de electricidad de origen renovable.

This article aims to study the regulation of the ‘guarantees of origin’ in relation with the final consumer of electricity produced from renewable sources of energy. In this way, firstly this paper examines how this figure is been regulated widely both by the EU Law and the Spanish Law. Secondly, in the context of the legislation examined, this work studies the definition of the guarantee of origin established in the Spanish regulation. Finally, in connection with the consumers of renewable energy electricity, this paper identifies which is the final consumer of electricity with guarantee of renewable origin and also gives some ideas relating to the current importance of these guarantees of origin and to the protection of the consumers of renewable energy electricity.
