In the last few decades, the legal institution of marriage has witnesses a progressive reduction of judicialization and has in practice become a 'private affair' of the spouses. The reformed separation and divorce system, allows for the personalization of the solutions offered in case of matrimonial crisis and a less interference of the public system in such a private issue. In fact, marriage has lost its 'public value', and the public powers just maintain a minimum role of legality control and protection of the minors' best interest. The strong similarity between Spanish and Italian system regarding the privatization process of the matrimonial issues is highlighted in this text. [--]
