L’interprétation juridique des états d’urgence (France – Espagne)

Abstract

Para luchar contra los peligros excepcionales que amenazan su supervivencia, el Estado liberal se enfrenta a la necesidad de afectar temporalmente el derecho ordinario. Si representa la esperanza de una posterior vuelta a la normalidad, cuando no el escudo mismo del Estado de Derecho, el estado excepcional también conduce a una profunda desestabilización de la jerarquía de las normas y de los órganos, debilitando así las garantías más fundamentales del sistema jurídico. Este odioso caso fronterizo de una ley llevada a sus límites más lejanos es, por esta misma razón, un acceso directo al conocimiento de las relaciones de poder, del funcionamiento determinante del juego institucional y, en fin, del funcionamiento real de la ley que, en tiempos ordinarios, se esconde bajo el barniz de la ficción jurídica. A través de un riguroso positivismo jurídico, pero liberado del ideal kelseniano de pureza y sus aporías, este estudio realiza un análisis empírico y comparativo de los datos más críticos de la aplicación de los estados de excepción en Francia y España. Basándose en estas observaciones, desarrolla una concepción corregida de la interpretación jurídica, renovando la comprensión del entrelazamiento del conocimiento y la voluntad que subyace. Resueltamente fructífero, nos invita a reinventar con pragmatismo las armas que la ciencia del derecho se da para comprender la práctica contemporánea de los estados excepcionales.

To fight against the exceptional perils that threaten to undermine it, the liberal-democratic state is forced to temporarily reach the rule of law. If it incarnates the hope of a later return to normality, if not the actual shield of the rule of law, the state of emergency also entails a profound destabilization of the hierarchy of norms and organs, weakening the most fundamental guarantees of the legal system. Odious borderline case of a legality pushed to its furthest limits, it is, for this same reason, a direct access to the knowledge of power relationships, of the determining mechanisms of the institutional game and, finally, of the real functioning of the law which, in ordinary times, smoulders out of sight, under the veneer of legal fiction. Through a rigorous legal positivism but freed from the Kelsenian ideal of perfection and its aporias, this study conducts an empirical and comparative analysis of the most critical data of the application of states of emergency in France and Spain. Based on these observations, it suggests an amended conception of legal interpretation, renewing the understanding of the intertwining of knowledge and will that it underlies. Resolutely fertile, it invites to reinvent with pragmatism the tools that the legal science gives itself to enlighten the contemporary practice of states of emergency.
