Las cláusulas claim made constituyen una forma de delimitar
temporalmente la cobertura del seguro de responsabilidad civil, condicionándola a que la
reclamación del tercero perjudicado se verifique en un concreto periodo de tiempo. La
necesidad de establecer este tipo de limitaciones deriva del hecho de que es habitual que
los daños se manifiesten tiempo después de haberse verificado el hecho del que traen
causa. Por ello, las compañías aseguradoras persiguen evitar exponerse al riesgo de tener
que indemnizar daños mucho tiempo después de haberse extinguido la relación
contractual con el asegurado. Inicialmente, la jurisprudencia las declaró nulas por
considerarlas lesivas para el asegurado, pero en 1995, el legislador les dio cobertura
normativa mediante la reforma del artículo 73 de la Ley de Contrato de Seguro. A pesar
de ello y como consecuencia de la existencia de una casuística muy variada, la aplicación

insurance coverage, making it conditional upon the claim of the injured third party being
verified within a specific period of time. The need to establish this type of limitation
derives from the fact that it is common for damages to manifest themselves some time
after the event from which they arise has occurred. For this reason, insurance companies
seek to avoid exposing themselves to the risk of having to compensate damages long after
the contractual relationship has been terminated. Initially, the jurisprudence declared them
null and void because it considered them harmful to the insured, but in 1995, the legislator
gave them regulatory coverage through the reform of Article 73 of the Insurance Contract
Law. In spite of this, and as a consequence of the existence of a wide variety of cases, the
