Violencia de género: regulación presente y futura

Abstract

En el trabajo se pone de manifiesto la importancia de la distinción entre los conceptos de violencia doméstica y de género para después analizar las últimas reformas legales relativas a esta materia y mostrar cuál ha sido la repercusión y las consecuencias de tales reformas. Se evidencia una crítica muy fuerte hacia la regulación establecida en la LO 1/2004 por la protección reforzada otorgada a la mujer y la elevación de algunas faltas a delito. Se muestran, por último, aquellas cuestiones que en materia de violencia de género van a ser modificadas tras la entrada en vigor de la LO 1/2015. Tras analizar tantas reformas penales y ver en qué situación estamos deberíamos empezar a plantearnos si es el Derecho penal el instrumento adecuado para la solución a este fenómeno o si lo correcto sería buscar la solución por otras vías menos represivas pero más efectivas para erradicar el problema.

At work is palpable the importance of making the difference between two concerts: domestic violence and gender violence, por then analizying the last penal reforms at this area and show the implications and consequences of that changes. It is visible a hard critic against the regulation established in the OL 1/2004 because of the strong protection given to women and the lifting of some offenses to the condition of crime. It shows, at the end, those questions in gender violence are going to be modified after the entrance of the OL 1/2015. After analizying that penal reforms and see in which situation we are, we could start to wonder if the criminal law is the best instrument for giving a solution to this problema or if the right thing will be searching the solution in less repressive but more effective ways to eradicate the problem.
