| es_ES |
dc.description.abstract | Noise is a major environmental, health and public order concern in modern societies. Despite the proliferation of ways to protect against this singular form of contamination, the decisive step in the fight against noise was made by the European Court of Human Rights when it admitted the possible involvement of a diverse group of fundamental rights. The aim of this paper is to critically analyze the steps taken by the European Court of Human Rights in indirect protection against noise. Under the European Convention on Human Rights, Article 8.1 refers to the right to respect for private and family life and home and it has been the real driving force behind the recognition of protective duties from excessive noise. This paper analyzes the different material and procedural conditions that determine the violation of article 8, although other human rights will also be studied to the extent that they have participated in this important jurisprudential work. | es_ES |
