Los derechos de la mujer en el Antiguo Régimen: una aproximación desde las fuentes castellanas

Abstract

El presente trabajo aborda la situación jurídica de la mujer en el Antiguo Régimen centrándose, aunque no de manera exclusiva, en las Siete Partidas de Alfonso X como fuente jurídica. La diferenciación principal a través de la cual vertebramos el trabajo es el estado civil, haciendo hincapié en los aspectos concernientes al matrimonio, puesto que es en esta institución especialmente donde se manifiesta más claramente en las fuentes la situación jurídica femenina durante este periodo. Asimismo esta institución actúa como elemento diferenciador en la condición jurídica de las mujeres que se encuentran casadas y las que no. Haremos también una pequeña referencia a las mujeres marginadas, que quedan fuera de la distinción anterior, a las que el derecho apenas ampara. A lo largo del trabajo intentaremos llegar a ver si había diferencias en el tratamiento jurídico de hombres y mujeres y por qué se establecían estas diferencias.

This paper aims to make a review on the legal status of women in the Ancient Regime, focusing, yet not exclusively, on the Seven-Part Code of Alfonso X of Castile as legal source. This paper is going to be structured by the marital status, analyzing the key aspects of marriage specially, because marriage is where we find most of the specific legal regulation for women. Marriage differentiates women and divides them into the married ones and the unmarried, and these two groups are going to be treated differently by the legal regulations. We will also make a quick review on the legal status of the marginalized women, who do not get much protection from law, to complete the study. Throughout this study we will try to find out if the regulations differ for women and men and if they did, why.
