dc.description.abstract | La reciente STS de 21 de enero de 2014 (RJ 2014, 531) ha sentado doctrina sobre la regulación de la usucapión contra tabulas poniendo fin al largo debate doctrinal que planteaba dudas acerca de la posible vigencia o derogación del art. 1949 CC por el art. 36 LH. El objetivo del presente trabajo es analizar las discordancias existentes entre el Código Civil y la Ley Hipotecaria en torno a la regulación de esta figura, así como el estudio de la emblemática STS a partir de la cual el art. 1949 CC se entiende derogado por el art. 36 LH. Asimismo, contiene un enfoque actual de la situación reflejado a través de la doctrina y jurisprudencia que ha interpretado el contenido del precepto hipotecario respecto de los requisitos que debe reunir el tercero para ser protegido frente al usucapiente. | es_ES |
dc.description.abstract | The recent sentence issued by the Supreme Court on 21st January, 2014 has established a new doctrine regarding the regulation of usucaption contra tabulas ending a long doctrinal debate which raised doubts surrounding the validity of the article 1949 of the Civil Code or its possible substitution for the article 36 of the Mortgage Act. The aim of this dissertation is to analyse the current discrepancies between the Civil Code and the Mortgage Act concerning the regulation of this concept as well as the study of the emblematic Supreme Court sentence, as a result of which, the article 1949 of the Civil Code is understood to have been replaced by the article 36 of the Mortgage Act. Additionally, it contains a contemporary perspective of the situation derived from the doctrine and precedent which include an interpretation of the content of the mortgage law regarding the requirements a third party ought to satisfy in order to be protected when facing a case of usucaption. | en |
