dc.description.abstract | El terrorismo es un fenómeno complejo, que no cuenta con una clara caracterización en ninguna rama del conocimiento. Ello conduce a que el Derecho tampoco haya encontrado una solución inequívoca para él en términos de régimen jurídico aplicable. Aun así, existen numerosas normas, medidas y estrategias en la materia, tanto a nivel internacional como interno. Esta investigación constata cómo el vigente acervo antiterrorista (procesal penal y penal sustantivo) español y su aplicación es incompatible en muchos aspectos con los principios limitadores del ius puniendi de un Estado social y democrático de Derecho y con los derechos fundamentales. Este trabajo identifica y argumenta estas colisiones entre la legislación antiterrorista y la constitucional e internacional, y realiza numerosas propuestas de interpretación y de reforma. | es_ES |
dc.description.abstract | Terrorism is a complex phenomenon that lacks a clear definition in any academic discipline. Therefore, the Law has not been able to provide a definitive solution in terms of its applicable framework. Even so, there exist a variety of regulations, measures, and strategies regarding terrorism, both at domestic and international level. The present research shows how the Spanish counter-terrorism law (criminal procedure law and substantive criminal law) and its judicial application undermine in many respects the limits of the criminal law of a social and democratic state governed by the rule of law and its fundamental rights. The study identifies and argues these incompatibilities between counter-terrorism legislation and constitutional and international law and offers numerous proposals for interpretation and amendment. | en |
