Publication Open Access La accesibilidad universal y su gestión como elementos imprescindibles para el ejercicio de los derechos fundamentales(2016) Miranda Erro, Javier; Campione, Toni Roger; Derecho Público; Zuzenbide PublikoaEl objetivo de este trabajo es investigar la realidad sobre la gestión para lograr la adecuada consecución de la accesibilidad universal (AU). Con este fin, es necesaria la aplicación de una metodología científica que permita, una vez contemplados y analizados los aspectos teóricos y prácticos más importantes del objeto de estudio, extraer conclusiones respecto a la distorsión, y también tensión, que se produce entre el derecho y el hecho, entre lo que debe ser y lo que es. Interesan sobre todo en esta investigación los resultados obtenidos, las conclusiones del análisis de campo y su impacto sobre el sujeto de derecho.La ciencia es el conjunto de técnicas y métodos que nos permiten organizar el conocimiento sobre la estructura de hechos objetivos y al alcance de distintos observadores. Tendríamos así que, por fin, el problema secular de la coordinación de la Administración periférica del Estado encuentra una solución satisfactoria, según parece, con la decidida apuesta por proporcionar al Delegado del Gobierno creado por la Constitución la posición institucional y los medios adecuados para ello. Nacido en Tudela en 1944, obtuvo su doctorado en Derecho por la Facultad de Derecho de la Universidad de Valladolid. Enseñó en esta Facultad de Derecho, y en las de las universidades de Salamanca, Alcalá, y Pública de Navarra. Ha tenido una larga experiencia internacional en Francia, Italia, Suiza, Moldavia, Polonia, Turquía, Canadá, Estados Unidos, Bolivia, México y Túnez. En 2003 fue premiado con el Doctorado Honoris Causa por la Universidad Nancy-2 (Francia). Ha desarrollado asimismo una amplia carrera como servidor público, desde el puesto de director general de Administraciones Públicas. Sus principales contribuciones y publicaciones se han centrado en el estudio de la estructura del Estado, de las Comunidades Autónomas en España, la idea de Nación, la institución del Defensor del Pueblo, la Unión Europea, y la teoría general del derecho público.Publication Open Access Algunas consideraciones sobre la Ley Foral del Impuesto sobre la Renta de las Persona Físicas(Gobierno de Navarra, Departamento de Presidencia, Justicia e Interior, 1992) Hucha Celador, Fernando de la; Derecho Público; Zuzenbide PublikoaTras un período de incertidumbre, y ya iniciado el período impositivo de 1992, el Parlamento de Navarra ha aprobado la Ley Foral 6/1992, de 14 de mayo, del Impuesto sobre la Renta de las Personas Físicas (en adelante, LFIRPF), que, como su homónima estatal, trata de adaptar, de forma definitiva el sistema de imposición personal sobre la renta de la Comunidad Foral a la doctrina sentada por el Tribunal Constitucional en su Sentencia 45/1989, de 20 de febrero. La Ley Foral 6/1 992 ha sido parcialmente desarrollada -con inusual. aunque explicable, celeridad- por el Decreto Foral 209/1 992, de 8 de junio, que aprueba el Reglamento del Impuesto sobre la Renta de las Personas Físicas (en adelante, RFIRPF); pese a su denominación, estamos en presencia de una norma que, en puridad, no constituye un verdadero y propio reglamento del impuesto , sino una regulación, aislada y asistemáiica, de algunas de las materias contenidas e n la LFIRPF, debido a que la extensión y prolijidad de ésta hace, en ocasiones, innecesario - salvo para incurrir en repeticiones- el recurso al desarrollo reglamentario de sus normas. Sobre estas bases pergeñaremos el presente trabajo que no pretende agotar el examen de la nueva imposición personal sobre la renta de las personas físicas, sino que queda circunscrito a una reflexión sobre dos aspectos de la nueva Ley Foral que, a nuestro juicio, Llenen una evidente trascendencia dogmática y una patente utilidad para el estudioso del Derecho Tributario navarro: en concreto, el modelo de tributación con junta elegido por Navarra y los criterios de sujeción al poder tributario navarro en el ámbito de la imposición personal sobre la renta de las personas físicas. El propósito que anima este trabajo - modesto, pero con dificultades intrínsecas que no es necesario real zar- hace que juzguemos inexcusable referirnos, previa y breve mente, al peculiar iter seguido por nuestra Comunidad foral para , en el ejercicio de Su poder tributario , adaptar el IRPF a la doctrina del Tribunal Constitucional, que, como, es sobradamente conocido, niega la posibilidad de que el legislador ordinario establezca sistemas de acumulación obligatoria de las rentas de los miembros de la unidad familiar. La STC 45/1989 se decanta por un modelo de IR PF que, necesariamente debe tener en cuenta a la persona física que obtiene rentas aisladamente considerada, esto es, por un modelo que, a diferencia del sistema establecido en la Ley 44/ 1978, de 8 de septiembre, debe prescindir, para determinarla prestación tributaria, de su integración o no en una unidad familiar; ello no supone, evidentemente, la proscripción, por inconstitucional, de cualquier sistema de tributación conjunta, sino únicamente de aquéllos que no permitan a los sujetos pasivos optar por un modelo de tributación individual.Publication Open Access El Amejoramiento del Fuero: una valoración desde la actualidad(FEDHAV, 2015) Hucha Celador, Fernando de la; Derecho Público; Zuzenbide PublikoaDesde el acceso de Navarra a la condición de Comunidad Foral se han sucedido una serie de pronunciamientos del Tribunal Constitucional que han influido notablemente en una recentralización del Estado autonómico y una invasión de la foralidad. Dejando de lado polémicas doctrinales sobre el carácter o no de Estatuto de Autonomía singular del Amejoramiento del Fuero de Navarra, nos centramos, para determinar la naturaleza jurídica de Navarra en la jurisprudencia constitucional. Se examina el proceso peculiar de acceso de Navarra a la condición de Comunidad Foral, las vías de reforma del Amejoramiento, así como la necesidad de democratizar el régimen foral. Los tribunales han castigado penalmente estos casos aplicando el art. 325 CP, incluido dentro de los delitos contra el medio ambiente y los recursos naturales. Se analiza brevemente los argumentos utilizados por el TS para condenar la contaminación acústica a través del delito medioambiental y, a tenor de la reforma operada por LO 1/2015, de 30 de marzo que modifica sustancialmente estos delitos, se establecen hipótesis de actuación por parte de los tribunales en esta materia.Publication Open Access Articulación autonómica de las competencias locales tras la LRSAL: hacia una autonomía local como derecho(Gobierno Vasco. Instituto Vasco de Administración Pública, 2015) Zoco Zabala, Cristina; Derecho Público; Zuzenbide PublikoaLa normativa autonómica de urgencia ha blindado las competencias locales en materias autonómicas que la LRSAL reduce, o vincula a exigencias estatales de financiación y de costes efectivos. Se fundamenta en que la ley básica no se identifica con las competencias locales, sino con el marco de homogeneidad mínima para el libre ejercicio de tales competencias en materias de titularidad autonómica; se basa también en la autonomía local como derecho de intervención de los entes locales en los asuntos que sean de su interés graduándose la intensidad de su participación en función de la relación existente entre intereses locales y supralocales (art. 137 CE). Para lograr tales garantías, de modo objetivo, es precisa una reforma constitucional que identifique la norma básica con un contenido esencial o principial, garante de una homogeneidad mínima. Mientras no se consiga la sensibilización de los fieles católicos, quizás tengamos que seguir recordando infructuosamente el propósito declarado por la Iglesia Católica en el apartado 5 del artículo II del Acuerdo de Asuntos Económicos de 1979, de lograr por sí misma los recursos suficientes para la atención de sus necesidades. Historia, identidad y autogobierno: noticia de tesis(Universidad Pública de Navarra / Nafarroako Unibertsitate Publikoa, 2017) Alli Aranguren, Juan Cruz; Derecho Público; Geografia eta HistoriaLa tesis expone la evolución del régimen foral de Navarra desde el modelo que heredó y gestionó la Diputación Foral franquista y la influencia sobre el mismo de la Constitución de 1978 para llegar al contenido material de la versión de los derechos históricos de Navarra que se plasma en la LORAFNA. Dentro del mismo se analizan sus principios, mitos y representaciones, que han sido objeto de nuevos tratamientos, con variaciones, mutaciones, superaciones o derogaciones por su propia obsolescencia o por las exigencias del nuevo orden constitucional. Aquellos, aunque los recojan las normas para tranquilizar conciencias, evitar conflictos, apoyar identidades y buscar adhesiones, no por eso tienen más valor que el de la realidad sobre la que se construyen. Se ha constatado que, si el régimen foral tenía escaso fundamento dogmático-constitucional en el debate sobre la naturaleza jurídica de la ley de 1841, sobre él se producía sobreactuación y mucha emotividad, conveniente y periódicamente excitadas.
