La atribución del uso de la vivienda familiar. En particular, de la vivienda propiedad de tercero

En el presente trabajo se analizará la atribución del uso de la vivienda familiar, sobrevenida la crisis matrimonial o ruptura de pareja, en especial, cuando la vivienda es propiedad de terceros. Para el estudio pormenorizado de este supuesto se hará un acercamiento al concepto de vivienda familiar, a los criterios de atribución empleados por el juez en defecto de pacto entre los cónyuges y a la naturaleza jurídica de la atribución del uso, para finalmente centrar el estudio en las particularidades que existen cuando la vivienda familiar no es propiedad de ninguno de los cónyuges o miembros de la pareja. En relación a la vivienda propiedad de terceros, se examinarán tres supuestos: la cesión gratuita del uso de la vivienda familiar, la construcción o rehabilitación de la vivienda familiar en suelo propiedad de un tercero y la vivienda familiar arrendada.

This paper will analyse the attribution of the use of the family home after the marital crisis or break-up of the couple, especially when the home is owned by third parties. For the detailed study of this case, an approach will be made to the concept of the family dwelling, to the criteria of attribution used by the judge in the absence of agreement between the spouses, and to the legal nature of the attribution of the use, to finally focus the study on the particularities that exist when the family home is not owned by either of the spouses or members of the couple. In relation to the dwelling owned by third parties, three cases will be examined: the free transfer of the use of the family dwelling, the construction or rehabilitation of the family dwelling on land owned by a third party and the leased family dwelling.
