| dc.description.abstract | La regulación del derecho de superficie por la legislación del suelo ha sido un tema tradicionalmente polémico. La doctrina ha ofrecido diferentes tesis sobre su ámbito de aplicación, la caracterización de ese derecho, o la posible compatibilidad de esa legislación con las escasas normas que se recogen de esa figura en el Código civil. A estas cuestiones se ha unido la controversia sobre las competencias de las Comunidades Autónomas para disciplinar esta institución civil en su legislación urbanística. La regulación que ofrece el Real Decreto Legislativo 2/2008, de 20 de junio, abre nuevos caminos de reflexión sobre todas estas cuestiones en las que ha jugado un papel fundamental la jurisprudencia del Tribunal Supremo y el parecer del Tribunal Constitucional. | es_ES |
| dc.description.abstract | The regulation of the surface right, that take refuges in the legislation of the ground, has been a traditionally controversial subject. The doctrine has offered different theses on its scope of application, the character of that right surface, or the possible compatibility of those norms with the little regulation that welcomes the civil Code. To these questions the controversy has been united on the competitions that Autonomous Communities have to approach the discipline of this civil institution in their city-planning norms. The new regulation that offers the Real Legislative Decree of 2/2008, of 20 of June, lays new ways of reflection on all those questions in which they have played a fundamental role the jurisprudence of the Supreme Court and criterion of the Constitutional Court. | en |
