| dc.description.abstract | El sistema de responsabilidad patrimonial de la Administración en el ámbito sanitario ha evolucionado paulatinamente con el paso de los años, consolidando notables cambios en este campo que facilitan la labor de los centros y profesionales sanitarios y mejorando la atención recibida por los ciudadanos, pero, de forma coetánea, produciendo desavenencias e imprecisiones normativas que, debido a estos avances, colisionan con la salvaguarda al derecho de la salud y del resarcimiento íntegro de los perjuicios ocasionados, bienes jurídicos objeto de especial protección. El objetivo de este trabajo es analizar exhaustivamente la situación jurídica actual que configura la responsabilidad patrimonial de la Administración sanitaria, tratando de examinar las diferentes normas y cambios jurisprudenciales producidos, y, como consecuencia, proporcionar una visión general que permita determinar si los objetivos inicialmente estipulados por el legislador se han visto respaldados por uno de los pilares fundamentales de cualquier sector, la seguridad jurídica. | es_ES |
| dc.description.abstract | The system of patrimonial responsibility of the Administration in the health field has evolved gradually over the years, consolidating notable changes in this field that facilitate the work of health centers and professionals and improving the care received by citizens, but, contemporary form, producing disagreements and regulatory inaccuracies that, due to these advances, collide with the safeguarding of the right to health and full compensation for the damages caused, legal assets subject to special protection. The objective of this work is to comprehensively analyze the current legal situation that configures the patrimonial responsibility of the Health Administration, trying to examine the different norms and jurisprudential changes produced, and, as a consequence, provide a general vision that allows determining whether the initially stipulated objectives by the legislator they have been backed by one of the fundamental pillars of any sector, legal certainty. | es_ES |
