| dc.description.abstract | El arbitraje societario es aquel por el que se resuelven las controversias internas de una sociedad. Figura de gran tradición histórica, aunque con un éxito relativo en nues-tros días, presenta diversas especialidades relacionadas, en primer lugar, con el conve-nio arbitral, que podrá incluirse en los estatutos sociales y podrá vincular a terceros. En segundo lugar, es necesario conocer qué materias societarias son arbitrables, y, para ello, habrá que atender entre otros criterios al principio de disponibilidad. Dentro de los conflictos susceptibles de arbitraje, serán especialmente relevantes las reformas legisla-tivas encaminadas a la aceptación de la arbitrabilidad de la impugnación de acuerdos sociales. | dc.description.abstract | Corporate arbitration is where intern corporate disputes are solved. This institution has a great historic tradition in our country, despite its relative success nowadays, and presents various peculiarities related to the arbitration agreement in the first place, which could be included in the articles of association and could bind third parties. In the second place, it is necessary to know which corporate subjects are arbitrable and, to that end, some criteria such as the principle of availability must be applied. In addition, leg-islative reforms focused on the acceptation of arbitrability of challenging corporate agreements have their special relevance within the conflicts which can be settled by arbitration.
