| dc.description.abstract | La forma en que se produce el ingreso de personas mayores en centros residenciales es una cuestión importante en una sociedad que afronta un proceso de envejecimiento y un aumento del número de personas que precisan de un cuidado integral. A pesar de ello, el legislador únicamente ha abordado este asunto en la Ley 39/2006 de Promoción de la Autonomía y Atención a la Dependencia, y han sido las leyes de servicios sociales de las Comunidades Autónomas las que han tratado de establecer un marco regulador, primando por encima de todos los requisitos el de la voluntariedad en el ingreso y permanencia en el centro. Sin embargo, la cuestión no se ha resuelto con esta regulación, como demuestran los recientes pronunciamientos del Tribunal Constitucional. | es_ES |
| dc.description.abstract | The way in which elderly people are admitted to nursing homes is a crucial issue in a society facing and ageing process and an increase of the number or people who need comprehensive care. Despite that, the legislator has only tackled this issue in Act 39/2006, on the Promotion of Autonomy and Attention to Dependency, and it has been the social services acts of the Autonomous Communities that have attempted to establish a regulatory framework, giving priority to voluntariness in the admission and permanence in the center above other requirements. However, the issue has not been solved with this regulation, as the recent pronouncements of the Constitutional Court show. | en |
