Arbitraje internacional de inversiones : las perspectivas de presente y futuro

El objetivo principal de este trabajo es dar a conocer uno de los métodos de gestión de disputas internacionales que existen en la actualidad como es el arbitraje internacional de inversiones y exponer las problemáticas actuales del sistema y las posibles soluciones futuras. Con el fin de contextualizar el tema que se tratará, se realizará una exposición sobre las principales características y normativa de este mecanismo de resolución de controversias. Para dar a conocer cómo se lleva a cabo un procedimiento arbitral, se expondrán las diferentes alternativas a las que las partes pueden acudir y el funcionamiento de cada una de ellas. Estos puntos introductorios que establecen las bases del concepto de arbitraje de inversiones ayudaran a entender, las problemáticas actuales que presenta este tipo de arbitraje y cuáles son las posibles soluciones actuales y lo que se espera que ocurra en un futuro con este método de resolución de disputas.

The main objective of this work is to present one of the methods of international dispute management that currently exist, such as international investment arbitration and expose the current problems of the system and possible future solutions. In order to contextualize the topic that will be discussed, a presentation will be made on the main characteristics and regulations of this dispute resolution mechanism. In order to explain how an arbitration procedure is carried out, the different alternatives available to the parties and the functioning of each of them will be explained. These introductory points, which establish the basis of the concept of investment arbitration, will help to understand, the current problems presented by this type of arbitration and what are the possible current solutions and what is expected to happen in the future with this method of dispute resolution.
