El juicio verbal sumario para la recuperación inmediata de la posesión de las viviendas ocupadas ilegalmente

Este trabajo fin de máster afronta el estudio del procedimiento sumario para la recuperación inmediata de la posesión de una vivienda ocupada ilegalmente, que se crea por medio de la Ley 5/2018, de 11 de junio, de modificación de la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil, en relación a la ocupación ilegal de viviendas. Al respecto, examinaremos la justificación del nuevo mecanismo sumario y la respuesta del Tribunal Constitucional a la planteada inconstitucionalidad de dicha Ley 5/2018. Asimismo, se analizarán la legitimación activa y pasiva del procedimiento, así como las especialidades procesales de su ámbito objetivo. Se insistirá, además, en el íter procedimental del juicio verbal sumario para así, examinar sus singularidades y conocer si su mecánica es la más adecuada frente a los “okupas”.

This Master´s thesis deals with the study of the summery procedure for the immediate recovery of possession of an illegally occupied home, which is created by Law 5/2018, of 11th of June, amending Law 1/2000, of 7th of January, on Civil Procedure, in relation to the illegal occupation of dwellings. In this regard, we will examine the justification for the new summery mechanism and the Constitutional Court´s response to the appeal of unconstitutionality against the Law that created it. We will also analyse the active and passive standing of the procedure, as well as the procedural specialities of its objective scope. In addition, emphasis will be placed on the summery verbal trial procedure in order to examinate its singularities and to find out whether its mechanics are the most appropriate to deal with “squatters”.
