| dc.description.abstract | El objetivo de este trabajo es analizar cómo puede afectar la conducta del trabajador a la responsabilidad penal del empresario en los accidentes de trabajo. La cuestión se abordará, en primer lugar, a través del análisis de la configuración de los delitos contra los derechos de los trabajadores en nuestro Código penal y los principales problemas que plantea el artículo 316 CP. En una fase posterior se expondrán las principales ideas en torno a la “autopuesta” en peligro de la víctima, la concurrencia de imprudencias y su especial tratamiento en el ámbito que nos ocupa a fin de exponer la singular posición en la que se encuentra el trabajador como víctima, así como las consecuencias en la jurisprudencia. | es_ES |
| dc.description.abstract | The aim of this paper is to analyze how the worker’s behavior can influence the criminal liability of the employer in cases of accidents at work. The matter will be approached, firstly, through the analysis of the crimes against employees’ rights configuration in the Spanish Crime Code and the main troubles presented by article CC 316. In a following phase, the core ideas around the worker’s self-endangering, the gathering of imprudences and its special treatment in the present field will be exposed in order that the singular position in which the employee is placed being the victim will be showed, as well as its consequences in the jurisprudence. | es_ES |
