Hijos matrimoniales y extramatrimoniales en el Derecho sucesorio navarro

La ley 272 del Fuero Nuevo contiene una institución sucesoria específica que confiere a los hijos habidos de matrimonio anterior del causante unos determinados derechos sucesorios. Estos hijos tienen en la herencia de su padre/madre bínubos derecho a recibir al menos lo mismo que el más favorecido de los hijos de matrimonio ulterior o que el nuevo cónyuge. Dicha institución ha comenzado a presentar problemas en la práctica que están siendo resueltos por Jueces y Tribunales sin que los fallos tengan una misma dirección. El problema de fondo que late en todos esos fallos es el de la integración en la estructura de la norma de la extramatrimonialidad. El trabajo pretende desentrañar el sentido y justificación de la figura.

The law 272 from the Fuero Nuevo contains a specific succession institution which confers children from a decedent’s earlier marriage, concrete succession rights. These children whose either father or mother has remarried, have the right to receive from their father or mother’s heritage at least as much as the most favoured within the descendants from the new marriage or even the new spouse. Such institution has began to show some problems in practise which are being solved, without adopting a common pattern, by Courts and Judges. The problem arising beneath all these different decisions is how to integrate out of the marriage children in this rule which only considers children within the marriage. The research aims to unravel the sense and justification of this institution.
