Abstract
Desgaitasuna giza egoeraren parte da. Laneratzeari dagokionez, lege-tratamendu espezifikoa behar da pertsona hauentzat. Desgaitasuna duten pertsonek beren eskubideak gainerako pertsonen baldintza berdinetan erabili ahal izan ditzaten. Horretarako daukagun instrumentu legaletako bat Enplegu Zentro Bereziena da, zeina araudi propio baten bidez lantzen den (lan harreman berezia baitute). Lan honen bidez zentro hauen inguruko aspektu ezberdinak garatzen dira. Adibidez, enpresa berezi eta arrunten arteko subrogazio edo ondorengotza kasuetan zein hitzarmen aplikatuko den edo langile ezgaituek langile arrunten lan errendimendu bera garatzen dutenean zein soldata jasoko den. Disability is part of the human condition. In labor matters, specific legal treatment is needed for these people. People with disabilities should be able to use their rights under the same conditions as other people. One of the legal instruments we have for this purpose is the Special Employment Center, which is developed through its own law (since they have a special employment relationship). Through this work, different aspects of these centers are developed. For example, what agreement will be applied in cases of subrogation or succession between special and ordinary companies or what salary will be received when disabled workers perform the same job performance as ordinary workers. Finally, for people with disabilities to achieve adequate and prosperous integration into society, it appears that there are still gaps in this type of protected work.
