| dc.description.abstract | El contrato de leasing adquiere una gran importancia como instrumento de financiación empresarial. Sin embargo, la carencia sustantiva sobre el mismo ha provocado varias discrepancias en cuanto a su naturaleza y contenido desde la perspectiva de diversas disciplinas jurídicas. En este trabajo se analiza el tratamiento jurídico del contrato de leasing en el ámbito del derecho concursal en concreto se examina la regulación prevista en la ley concursal para la calificación del crédito por las cuotas del contrato de leasing devengadas con posterioridad a la declaración de concurso de la arrendataria financiera, así como en el alcance y extensión del privilegio especial que la ley reconoce a la sociedad de leasing cuando la arrendataria entra en concurso. | es_ES |
| dc.description.abstract | The leasing contract has acquired huge importance as financial instrument. Nevertheless, the lack of substantive regulation has caused several disagreements regarding to its legal status and content from the perspective of the different areas of law. This work focuses on the legal treatment of the leasing contract within the insolvency laws. Specifically, the work analyzes the regulation included in the Spanish insolvency law for the qualification of credits by the proportion of the leasing contract accrued after the declaration of insolvency of the lessee, as well as the scope and extension of the special privilege recognized by law to the leasing society when the lessee is immerse in an insolvency proceeding. | es_ES |
