| dc.description.abstract | El patrimonio sin contenido económico realizable bastante plantea el problema de su propia existencia en el tráfico jurídico, puesto que el acreedor ostenta la legítima expectativa al cobro de su crédito a la vez que el deudor precisa de una seguridad que permita actuar ante tamaño escenario. La doctrina ha abordado esta enrevesada situación, donde la respuesta de los operadores jurídicos, primero, vacilante, ahora ya clara, para, precisamente, aliviar escenarios angustiosos que ni a unos, ni a otros, satisfacía en absoluto. Precisamente, la situación de excesivo celo tuitivo ha propiciado su análisis por la Resolución de la Dirección General de los Registros y del Notariado de 2 de septiembre de 2019 evitando, de una vez por todas, que este escenario confuso, a modo de inextricable jerigonza, dibuje un retrato bizantino que, no solo a los actores, sino particularmente a la economía, conviene atajar favoreciendo el emprendimiento y, sobre todo, la dignidad de la persona. Asimismo, la reciente Resolución de la Dirección General de Seguridad Jurídica y Fe Pública de 4 de octubre de 2021 ahonda en esta cuestión. | es_ES |
| dc.description.abstract | The equity without sufficient realizable economic content raises the problem of its existence in the legal traffic, since the creditor has the legitimate expectation to collect his credit while the debtor needs a security that allows to act in such a scenario. The doctrine analyzes this convoluted situation, where the response of the legal operators, first, hesitantly, now already clear, to precisely alleviate distressing scenarios that neither one nor others satisfied at all. Precisely, the situation of excessive tweeting has led to the analysis by the Resolution of the General Directorate of Registries and Notaries of September 2, 2019 avoiding, once and for all, that this confusing scenario, as an inextricable jargon, draw a byzantine portrait that, not only to the actors, but particularly to the economy should be tackled by favoring entrepreneurship and, above all, the dignity of the person. Likewise, the recent Resolution of the General Directorate of Legal Security and Public Faith of October 4, 2021 addresses the issue. | en |
