| dc.description.abstract | This article, through comparative law, aims to analyze how the transfer of digital heritage occurs in the Brazilian and Spanish context. This is because, with technological advances, the need for legislation to follow such changes, establishing rules, meeting new demands, is evident. Indeed, legislation must respect constitutional guarantees, such as the privacy, intimacy and image of the deceased, in addition to the legal guarantees of internet and application providers. Thus, based on the deductive methodology, bibliographical and jurisprudential research was adopted, with a critical reading of works relevant to the research object. Concluding, in this way, that although there is still no regulation on the subject in the Brazilian scenario, there are movements that point in this direction, while, on the other hand, the Spanish legislation, through the Organic Law of Data Protection and Guarantees of Rights Digital, standardized the matter, with rules directly related to digital heritage, demonstrating that it is reasonably advanced in comparison to the new digital discussions in the Brazilian scenario. | en |
| dc.description.abstract | O presente artigo, por meio do direito comparado, objetiva analisar como ocorre a transferência da herança digital no contexto brasileiro e espanhol. Isto porque, com o avanço tecnológico resta evidente a necessidade de a legislação acompanhar tais mudanças, estabelecendo regras, atendendo as novas demandas. Com efeito, deve a legislação respeitar garantias constitucionais, como a vida privada, intimidade e imagem do falecido, além das garantias legais dos provedores de internet e de aplicação. Assim, a partir da metodologia dedutiva, adotou-se a pesquisa bibliográfica e jurisprudencial, sendo realizada a leitura crítica de obras pertinentes ao objeto da pesquisa. Concluindo, desta maneira, que embora ainda não haja no cenário brasileiro regulamentação sobre o tema, há movimentos que acenam para esta direção, enquanto, por outro lado, à legislação espanhola, por meio da Lei Orgânica de Proteção de Dados e de Garantias dos Direitos Digitais, normatizou a matéria, com regras diretamente atinentes à herança digital, demonstrando que está razoavelmente avançada em comparação as novas discussões digitais no cenário brasileiro. | pt |
