| dc.description.abstract | El presente trabajo tiene por objeto el estudio del derecho de huelga como principal instrumento de presión ejercido por el colectivo de trabajadores. Atendiendo a su condición de derecho fundamental se ha procedido a analizar las notas comunes del mismo, así como las garantías que posibilitan su protección y los límites que lo acotan. En consonancia, se profundiza en la sustitución del trabajador huelguista por ser el supuesto lesivo más frecuente en relación a este derecho, del cual se vale el empresario en su vertiente interna, externa, y actualmente también tecnológica. Teniendo en cuenta la novedad, y por consiguiente la falta de regulación del esquirolaje tecnológico, se ha elaborado un análisis jurisprudencial del concepto con el fin de esclarecer el término y analizar el uso del mismo en el ámbito laboral actual. | es_ES |

Era berean, grebalariaren legez kanpoko ordezkapenak sortzen duen egoera sakonki aztertu da, greba eskubidea kaltetzen duen egoera ohizkoena baita. Horrez gain, baliabide teknologikoek greba eskubidearen gain azken hamarkadan sortutako arazo berrien hausnarketa burutu da, auzitegiek gaiaren inguruan garatutako jurisprudentziaren ekarpenekin kontzeptua argitu eta egungo lan zuzenbidearen testuinguruan kokatuz. | es_ES |
| dc.description.abstract | This study aims to analyze the right to strike as the main instrument of pressure exercised by the group of workers. Taking into account its condition as a fundamental right, its common points have been analyzed, as well as the guaranties that make its protection possible and the limits that delimitate it. Accordingly, it focuses on the replacement of the striking worker, being this, the most wrongful scenario in relation with this right, which is used by the employer in its internal, external, and, currently, also technological dimension. Considering its newness, and consequently the lack of regulation over the technological strike-breaking, a jurisprudential analysis of this concept has been carried out with the objective of clarifying and analyzing its use among the labour context. | es_ES |
