| dc.description.abstract | Las condiciones de la ejecución penitenciaria, que afectan al nivel de restricción de la libertad, se vinculan con la evolución de las personas privadas de libertad en su proceso de rehabilitación. Las tendencias político-criminales del riesgo que se observan en las últimas décadas han dado lugar a que, en las evaluaciones de esa evolución, tenga un peso cada vez mayor la valoración del riesgo. En este sentido, destaca el uso de las herramientas de valoración y gestión de riesgos en el ámbito penitenciario y, en concreto, el protocolo RisCanvi en el sistema penitenciario catalán. Desde una perspectiva jurídico-penal, y desde la preocupación por el respeto a los derechos fundamentales de las personas privadas de libertad, en este trabajo, se plantea el análisis del uso que se hace del RisCanvi en la toma de decisiones penitenciarias. Para ello, se realiza un estudio a través de entrevistas a los agentes que participan en la toma de decisiones penitenciarias que pretende mostrar a qué realidad debe enfrentarse un Derecho penal con garantías. | es_ES |
| dc.description.abstract | Prison conditions, which affect the level of restriction of liberty, are linked to the evolution of people deprived of liberty in their rehabilitation process. Political-criminal trends of risk observed in recent decades have given rise to the fact that, in the evaluations of this evolution, risk assessment has an increasingly greater weight. In this sense, the use of risk assessment and management tools in the penitentiary environment and, specifically, the RisCanvi protocol in the Catalan penitentiary system, stands out. From a legal-criminal perspective, and from the concern for the respect of the fundamental rights of people deprived of liberty, this work proposes the analysis of the use of RisCanvi in the penitentiary decision making. Hence, a study is carried out with interviews to the agents that participate in the penitentiary decision making. It aims to show the reality that a criminal law with guarantees must face. | en |
