| dc.description.abstract | La reforma del Fuero Nuevo de Navarra por la Ley Foral 21/2019 ha permitido que se pueda valorar el ajuste de sus instituciones al marco competencial del art. 149.1.8ª de la CE. Admitida la existencia de «conexión institucional suficiente» para las modificaciones y desarrollos legislativos efectuados por el legislador foral, conforme al primer límite del art. 149.1.8ª de la CE, los reparos de constitucionalidad han tenido como eje de análisis la reserva competencial del Estado en materia de «normas de conflicto», «ordenación de los registros e instrumentos públicos» y «bases de las obligaciones contractuales». La respuesta dada a estas cuestiones en la STC 157/2021 confirma, en unos casos, y ofrece incertidumbres, en otros, sobre la dimensión que se persigue en la relación de la legislación civil autonómica con la estatal en nuestro sistema plurilegislativo civil. | es_ES |
| dc.description.abstract | The reform of the New Forum of Navarre by Foral Law 21/2019 has allowed for assessing the adjustment of its institutions within the competence framework of Article 149.1.8ª of the Spanish Constitution. Having been admitted the existence of “sufficient institutional connection” for the amendments and legislative developments carried out by the foral legislator, in accordance with the first reservation of Article 149.1.8ª Spanish Constitution, the repairs on constitutionality have had as a center of analysis the second State competential reserve, relating to the “rules of conflict”, “ordinance of public registries and instruments” and the “basis of contractual obligations»”. The answer to these questions provided by STC 157/2021 reinforces in some cases and offers uncertainties in others as to the dimension pursued of the relation between autonomic civil legislation and State legislation in our plurilegislative civil system. | en |
