El 8 de noviembre de 1995 se publicó en el BOE la Ley 31/1995 de Prevención de Riesgos Laborales en España, como transposición de una Directiva europea. Después de
25 años de su puesta en vigor se plantea la hipótesis de si realmente se han obtenido unos
resultados de mejora en el espacio europeo, español, autonómico y en una empresa
multinacional de componente de automoción. El objetivo general de esta tesis doctoral fue
analizar la siniestralidad a través de los accidentes laborales en jornada de trabajo en series
temporales superiores a 20 años, para poder evidenciar el impacto de dicha ley. Para
alcanzar este objetivo, se realizó un análisis estadístico de los diferentes tipos de accidentes
registrados y notificados al Ministerio de Trabajo y Economía Social y en la Oficina
Estadística de la Unión Europea. Como resultado, se observó que España ha mejorado sus
valores absolutos y su índice de incidencia de accidentes mortales desde el inicio del
estudio, sin embargo, estuvo por encima de la media de los países europeos comparados. A
nivel nacional, todas las comunidades autónomas mejoraron sus índices de incidencia y
frecuencia de los accidentes mortales en jornada de trabajo. La radiografía de la
siniestralidad es que 98,78% de los accidentes fueron leves, el 1,10% graves y el 0,1%
mortales. El prototipo de accidente mortal en jornada de trabajo fue de un varón,
representando el 95% del total, con una antigüedad inferior a 10 años, representando el
79,33%, y perteneciente mayoritariamente al sector económico de la construcción y agrario.
En la empresa analizada, también mejoraron los valores e índices de accidentabilidad. [--]

On November the 8th, 1995 there was a publication in the BOE, Law 31/1995
regarding Labour Risk Prevention in Spain was the result of a European directive
transposition. After 25 years since it became effective, there is a hypothesis about whether
there have been results that show improvement in the European, Spanish or Autonomous
space as well as in a multinational automotive components company. The main objective of
this doctoral dissertation was to analyse the accident rate in the workforce in temporary
series above 20 years thus demonstrating the impact of said law. In order to reach this goal,
a statistical analysis about the different types of accidents recorded and notified to the
Ministerio de Trabajo y Economía Social as well as The European Union Statistics office was
performed. The result has shown Spain has improved its absolute numbers as well as its
mortal accidents repercussion rate as soon as the study started. However, it was above
average in comparison to the other European countries who participated in the study.
Nationwide, all the autonomous communities improved their mortal accidents repercussion
and frequency rate in the workforce. A detailed picture of said accident rate shows that
98,78% of them were minor, 1,10% were serious and 0,1% were mortal. The prototype of a
mortal accident in a labour day at the workforce was one of a male, representing the 95% of
the total, with a career of less than 10 years, representing the 79,33%, and from the
economic sector of the construction and agricultural area. In the analysed company, the
figures and proportion of accidents also improved. [--]
