El "nomos" de la tierra en un mundo global. Carl Schmitt a la luz de las nuevas amenazas

El artículo se propone como una revisión del nomos de la tierra schmittiano a partir de las transformaciones que irrumpen con la globalización y con la crisis del monopolio legítimo de la violencia por parte del Estado nacional. En un contexto que algunos han definido en clave de postnacionalidad y donde se consolidan los desafíos globales (ecológicos, tecnológicos, bélicos) que surgieron en el siglo XX resulta interesante analizar las ideas de Carl Schmitt acerca de la toma de tierra como clave para el ordenamiento legal y para la sujeción civilizada de la violencia con las nuevas coordenadas trasfronterizas ligadas a las amenazas y a los riesgos de supervivencia.

The article aims to review the Schmittian "nomos" of the earth in the light of globalization and the crisis of the legitimate monopoly of violence by the national state. To this end, attention is paid to the new logic of global terrorism and the warlike responses to it. From there, the paper will delve into the difficulties of the ius publicum europaeum that Schmitt had already anticipated. In this journey, Schmitt's concept of the enemy and that of the Hobbesian leviathan from which he drew his inspiration will be analyzed first. Then, the concept of surgical warfare derived from drone warfare is addressed. And finally, attention is paid to the global threats that appear as uncertainties that require going beyond the limits of the national state in order to effectively confront them, thus calling into question the validity of Schmittian "nomos".
