| dc.description.abstract | Los métodos para adentrarse al conocimiento y análisis del sistema jurídico se han diversificado y la tradición anglosajona apuesta por aplicar conceptos y herramientas usados tradicionalmente en la ciencia económica, esto dio lugar al llamado Análisis Económico del Derecho (AED), el cual ha venido siendo acogido, paulatinamente, en los ordenamientos de tradición romano-germánica. En ese sentido, el presente trabajo consiste en un esfuerzo intelectual que conllevó; en primer lugar, plasmar el marco teórico del AED como disciplina emergente en el contexto jurídico contemporáneo de los sistemas bonapartistas; y, en segundo lugar, se retoma como herramienta iuseconómica la teoría de los costos de transacción aplicada al ámbito de la contratación electrónica, específicamente de los llamados clickwraps, mediante una investigación cualitativa a través de la aplicación del método exegético y la técnica documental, todo lo anterior bajo el enfoque del análisis aplicado. Como resultado se constató la necesidad de regular este tipo de contratos siguiendo la tradición del derecho mercantil internacional orientada a una uniformidad de los ordenamientos domésticos y atendiendo a estándares mínimos de regulación identificados; esto aporta a los ordenamientos del Civil Law con limitada regulación y escasos pronunciamientos judiciales en esta línea. | es_ES |
| dc.description.abstract | The methods for getting into the knowledge and analysis of the Legal System have diversified and the Anglo-Saxon tradition is committed to applying concepts and tools traditionally used in Economic Science, which gave rise to the so-called Economic Analysis of Law (EAL) that has been gradually adopted in the Roman-Germanic legal systems. In this sense, this work consists of an intellectual effort that involved, firstly, the shaping of the theoretical framework of EAL as an emerging discipline in the contemporary legal context of the Bonapartist systems, and secondly, the theory of transaction costs applied to the field of electronic contracting, specifically the so-called clickwraps, that is taken again as a legal-economic tool through qualitative research using the exegetic method and the documentary technique, all of the above under the of applied analysis approach. As a result, the need to regulate this type of contracts following the tradition of the International Commercial Law oriented to a uniformity of the domestic systems and attending to identified minimum standards of regulation was confirmed which contributes to the Civil Law regulations with limited regulation and few judicial pronouncements in this line. | en |
